FREE SPIRIT TENBY WILLS - 2008 BREEDING CONTRACT
 

This contract is entered into and is between the undersigned Moon Ridge Farm known as “STALLION OWNER” and the undersigned “MARE OWNER” and Craig D. Canner known herein as “STALLION MANAGER”. This contract sets forth the rights and responsibilities of the parties for the 2008 breeding season.

 

The stallion providing breeding services under this contract is Free Spirit Tenby Wills, WPCSA Registration # B-43650.

1.      In order for STALLION MANAGER to guarantee a breeding, MARE OWNER shall pay a non-refundable booking fee of $100.00 which is payable upon execution of this agreement. Otherwise, the non-booked MARE OWNER will not have priority over a booked MARE OWNER. The mare will not be released to the MARE OWNER or the owner’s agent until all fees are paid to date, to include mare care, stud fee and medical expenses(ultra sound or emergency). The STALLION OWNER and the STALLION MANAGER shall have a possessory lien on the mare for all unpaid bills. 2008 stud fee is $550 which includes the $100 booking fee.

2.      MARE OWNER shall deliver the mare in a healthy and sound breeding condition free from infection or disease. MARE OWNER agrees that STALLION OWNER and STALLION MANAGER have permission to have the mare treated by a licensed veterinarian for pregnancy examination, and have reasonable and necessary veterinary services performed for any condition which might insure the mare’s well-being as the STALLION MANAGER deems necessary or proper at the expense of the MARE OWNER. A current negative Coggins Test document shall be delivered to the STALLION MANAGER together with a photocopy of both sides of the registration papers for the mare. A veterinarian’s health certificate, worming and immunization record must accompany the mare. If said health documents do not accompany the mare the STALLION MANAGER shall notify the MARE OWNER and may direct a licensed veterinarian to examine and/or test the mare at the MARE OWNER’S expense. STALLION OWNER or STALLION MANAGER reserves the right to refuse the mare if the mare is not in satisfactory condition or if the mare is aggressive upon initial inspection. If the mare is refused, the booking fee shall constitute liquidated damages. A MARE OWNER may substitute another mare within that breeding season.

3.      MARE OWNER shall be invoiced at the first of each month for all interim expenses including but not limited to veterinary services, farrier services(if requested), special dietary services(if requested) as well as mare care expenses. Said invoices are to be paid by MARE OWNER upon receipt of statement. Such charges shall be paid in full whether or not the mare is settled.

4.      STALLION OWNER and STALLION MANAGER shall attempt with reasonable diligence to settle the mare; if however, for any reason the mare does not settle, MARE OWNER will hold STALLION OWNER and STALLION MANAGER harmless.

5.      The breeding season for Free Spirit Tenby Wills begins April 15 and closes June 15 of the year covered by this contract.

6.      STALLION OWNER guarantees a live foal from the breeding contracted for herein. “Live Foal” is defined as a foal that stands and nurses. Should the mare prove not to be in foal, aborts her foal or if the foal is still born, MARE OWNER shall notify the STALLION OWNER in writing within one week of the foaling date or the date the mare is proved not to be in foal or loses her foal. A written statement from a licensed veterinarian verifying that the mare has slipped or produced a non-viable foal must be sent to the STALLION OWNER.

7.      STALLION OWNER shall give the MARE OWNER a free season to the stallion the following year only, subject to the MARE OWNER paying boarding fees, veterinary expenses and blacksmith expenses as necessary for the re-breeding year.

8.      In the event the mare aborts, the MARE OWNER shall certify to the STALLION OWNER that the mare was accurately and properly administered vaccines to prevent the mare from aborting; such as booster rhinopneumonitis vaccinations administered as indicated by the individual drug manufacturer.

9.      All parties agree that the STALLION OWNER and STALLION MANAGER or their agents or assigns are not liable for death, sickness or accident including consequential damages caused to the mare or foal.

10.  A breeder’s certificate will be issued to MARE OWNER after all outstanding expenses have been paid and upon notification of the birth of the foal to the STALLION OWNER.

11.  MARE OWNER understands that the safety of the handlers, mare and stallion are priority. Should the mare be dangerous to the handler, stallion or to herself, the mare will be sent home and all expenses must be paid prior to the day or on the day that the mare is transported home.

12.  This contract shall be governed by the Laws of the State of Ohio and is hereby executed as of the date signed by the STALLION OWNER which date shall govern the effective dates of said contract.
